Mandatory evacuation from Donetsk oblast 

Cabinet Ordinance # 679-p of August 2, 2022 

Decision-maker: the Cabinet 

Who is affected: inhabitants of Donetsk oblast (on February 24, 2022, there were near 2 million people on the territory controlled by Ukraine), inhabitants of oblasts to which people will be evacuated, military administrations, the Ministry of Communities and Territories Development, the Ministry of Infrastructure, the Ministry of Reintegration of the Temporarily Occupied Territories, the Ministry of Internal Affairs, the National Police, the State Emergency Service, and the Security Service of Ukraine 

Summary of the ordinance: 

  • government bodies, military units, law enforcement agencies, and the Ukrainian Railways are ordered to organize and conduct an evacuation of the population from the territory of Donetsk oblast 
  • defines that inhabitants of Donetsk oblast should be evacuated to relatively safe oblasts: Vinnytsia, Volyn, Zhytomyr, Zakarpattia, Ivano-Frankivsk, Kirovohrad, Lviv, Poltava, Rivne, Ternopil, Khmelnytskyi, Cherkasy, and Chernivtsi 

What is right: 

  • the evacuation will decrease the number of casualties among the civilian population caused by constant indiscriminate russian airstrikes, rocket and artillery strikes 
  • inhabitants of Donetsk oblast will have access to water, electricity, and heat in winter. It is either impossible or significantly complicated to provide civilians with public utilities in Donetsk oblast due to constant strikes by the russian troops against the civilian infrastructure. 

What is wrong: 

  • the Cabinet’s decision on mandatory evacuation violates the Law on the Legal Regime of Martial Law: according to the law, such decisions are the responsibility of military command and military administrations. 

Increase in defense spending 

Draft bill # 7644 of August 8, 2022 

Cosponsors: a group of MPs with Oleksandr Zavitnevych as the first signatory 

Status: preparation for the first reading 

Who is affected: the Ministry of Finance, the Ministry of Economy, the Ministry of Defense, the Ministry of Internal Affairs, the Security Service, the State Security Administration, and the Foreign Intelligence Service 

Summary of the bill: 

  • spending from the government budget in 2022 will be increased by ₴270 bln received from internal loans 
  • this additional funding will be distributed as follows: 
  1. 269,5 bln — for the boost of the national security and defense 
  1. 10,3 mln — for measures to mobilize the national economy 
  1. 716 mln — for refilling the reserve budget fund. 

What is right: additional funding for defense is necessary during the war to maintain and strengthen the Armed Forces of Ukraine, other military units, and law enforcement agencies. 

What is wrong: budget deficit is growing constantly because of additional needs of the defense sector, but the Cabinet makes almost no cuts in other sectors that could have helped to compensate for the deficit. This results in an excessive increase in the national debt. 

Termination of the agreement with Belarus on the cooperation of defense enterprises 

Cabinet resolution # 858 of August 2, 2022 

Decision-maker: the Cabinet 

Who is affected: defense enterprises of Ukraine and Belarus, the Ministry of Foreign Affairs, and the Ministry of Defense. 

Summary of the resolution: 

  • terminates the agreement between the Cabinet and the government of Belarus on industrial and scientific cooperation between enterprises and organization of the defense sectors of the two countries 
  • orders the Ministry of Foreign Affairs to inform the government of Belarus about the termination of the agreement 

What is right: 

  • Belarus is an accomplice in the armed aggression of russia against Ukraine since it allows russia to use its territory for invading the territory of Ukraine. In particular, russia launches its rockets and sends its warplanes from Belarus. It is against the national interests of Ukraine to maintain friendly relations with Belarus. 

What is wrong: 

  • Although the territory of Belarus is being used as a base for the russian invasion from the first day of the full-scale war, the Cabinet terminates some of the agreements with a de facto hostile country only now.
