Summary: the bill proposes changes to the criminal legislation that will:
- systematize provisions regarding international crimes in the Criminal Code of Ukraine
- standardize procedural provisions regarding the investigation of international crimes in the Code of Criminal Procedure of Ukraine.
What is right: if the draft bill on criminal liability for international crimes is adopted, it will be necessary to harmonize the legislation. The draft bill introduces the required changes.
What is wrong: the Code of Criminal Procedure does not take into account the specifics of the trial and investigation required to conduct them efficiently. For example, regulations on how to gather evidence, conduct examinations, and organize international cooperation within the framework of collaboration with international organizations.
Alternative solution: to introduce special provisions that define the specifics of cooperation with foreign law enforcement agencies within the framework of implementing the Rome Statute. Consider international standards in criminal law and procedure and conduct broad consultations with experts in this field.
