Draft bill #10164-1 of November 6, 2023
Sponsor: MP from the Servant of the People faction Halyna Tretiakova
Status: adopted in the first reading
Who is affected: employees and employers
Summary:
- with the employer’s consent, an employee with a child under 14 who studies remotely will be allowed to work from home or remotely during the child’s schooling
- if a remote employee needs to go on a business trip, they will have to inform their employer in advance where they will be staying by any convenient means: via email, messenger, or phone
- the conditions for sending a remote employee on a business trip will be outlined in the employment contracts, including the methods of communication, conditions for expense reimbursement, and the order of assignments’ execution during the trip.
What is right:
- the bill adds the option for one parent to switch not only to remote but also to home-based work during the child’s remote schooling
- explicit agreement on conditions for business trips, schedules, and reporting will prevent employer abuses.
Why this is important:
Amendments to labor legislation are essential as current standards often do not reflect modern realities. For instance, remote work has become widespread due to the COVID-19 pandemic and the large-scale invasion, and flexible schedules and digital technologies are reshaping the labor market. Legislation has to adapt to the real needs of employees and employers, allowing productivity to be maintained even outside the office.
