Draft bill #11179 of April 15, 2024

Status: sent for review to the Committee of the Verkhovna Rada on National Security, Defense, and Intelligence 

Who is affected: service members in professional military service, military service by conscription, and contract service 

Summary: 

  • service members who served continuously under martial law for 36 months, of which at least 12 months they participated in combat operations against the aggressor state, will have the right to be demobilized 
  • to demobilize, a service member will have to submit a request. The request will be processed within one month after the service member submits it. 

What is right: the bill addresses the issue of demobilization of service members who are in service for a long time 

What is wrong: the provision regarding the demobilization after 36 months of continuous service will most likely not be feasible due to the scale of the war, the shortage of citizens ready to replenish the armed forces, and the threat of losing the most experienced military personnel. 

Alternative solution: to reduce dissatisfaction, a feasible and rational alternative can be offered to service members. For example, longer leaves and rotations to quieter sections of the front. 

Background information: the release of service members to the reserve was proposed in the mobilization bill adopted in the first reading on February 7, 2024. However, after revision by the dedicated committee, these provisions were excluded. 

A draft bill on demobilization was submitted on April 10 and is currently under review by the dedicated committee.
