Who is affected: administrative courts, the Kyiv City District Administrative Court (KCDAC), and the State Judicial Administration of Ukraine (SJA)
Summary:
- from the date this law comes into effect, the District Administrative Court of Kyiv City (DACKC) will cease to administer justice
- until the Kyiv City District Administrative Court starts operating, cases under the jurisdiction of the DACKC will be considered and resolved by the Kyiv District Administrative Court (KDAC)
- unresolved administrative cases that were transferred to KDAC from the DACKC and distributed among judges before this law comes into effect will be considered and resolved by the KDAC. Other cases that were not distributed among judges will be forwarded for review and resolution to other district administrative courts through automated distribution. The distribution will be conducted randomly but taking into account the workload and the chronological order of submission of the cases
- the appeal court for all cases under the jurisdiction of the DACKC (it covers the city of Kyiv) that will be transferred to other district administrative courts under this law, will be the Sixth Appeal Administrative Court
- the SJA must develop procedures for the transfer of cases within 60 days, after which the law will come into effect immediately.
What is right: the law will finalize the process of liquidating the DACKC. The work of the DACKC was accompanied with numerous corruption scandals.
