Who is affected: candidates applying for positions with high corruption risk, public officials, the National Agency on Corruption Prevention, the High Council of Justice, the High Qualification Commission of Judges, the Council of Judges, the National Agency for Civil Service, and the Security Service of Ukraine
Summary:
- state bodies will be able to independently conduct a special check on an individual applying for a certain position
- special check will be conducted based on data from state electronic information resources, such as the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations, the Unified State Demographic Register, the State Register of Real Property Rights, etc.
- the list of data subject to special check will include the following:
- ownership of corporate rights, especially packages of voting shares in joint-stock companies (5% and more)
- health status (concerning the absence of mental disorders, especially those caused by the consumption of psychoactive substances), education, and possession of a scientific degree or academic title
- the Security Service of Ukraine will no longer conduct special checks on whether a person has access to state secrets.
What is right: there will be less paperwork, special checks will be conducted quicker
Background information: since March 2022, special checks have been suspended. They were resumed when the law restoring electronic asset declarations came into effect on October 12, 2023
