Draft bill #11468 of August 7, 2024

Status: sent for review to the Committee on National Security, Defense, and Intelligence 

Who is affected: employees of private, municipal, and state enterprises, establishments, and organizations 

Summary: 

  • employers will have the right to reserve their employees from any enterprise, establishment, or organization 
  • the following conditions will have to be met to get this right: 
    • absence of tax debt or other payment arrears for the employer 
    • employees applying for military reservation will be required to confirm that they have updated their military registration data via the electronic cabinet or at the recruitment center in their area 
  • the limit of reserved employees will be 30% of the total number of persons subject to military service. 

What is right: there will be more categories of persons subject to military service eligible for reservation. This will allow not only enterprises but also private entrepreneurs to reserve their employees subject to military service during mobilization in a state of war. 

What is wrong: the right to reserve their employees will be granted not only to organizations working for the Defense Forces or included in the list of critical enterprises. 

Alternative solution: to revise the draft bill, in particular, to clearly define the criteria for reserving genuinely highly qualified employees. This will help balance the needs of the army with the operational requirements of the economy. 

How to help the legislator: proposals concerning the draft bill can be sent to the Committee of the Verkhovna Rada of Ukraine on National Security, Defense, and Intelligence 

Background information: on April 11, 2024, the Verkhovna Rada passed a mobilization law with the deferment and reservation procedure for persons subject to military service. Previously, the Ministry of Strategic Industries had published clarifications on the reservation criteria and procedure.
