Presidential decree #84/2024 of February 21, 2024

Status: in effect since February 21, 2024 

Who is affected: the National Guard of Ukraine and foreigners and stateless persons — legal residents of Ukraine 

Summary: 

  • foreigners and stateless persons will be eligible for military service under contract in the National Guard of Ukraine and serve as: 
    • privates 
    • sergeants and sergeant majors 
    • a person can enlist at the territorial recruitment center or apply directly to a military unit of the National Guard 
  • to sign a contract, the applicant will have to: 
    • undergo a medical examination by a military medical commission at a healthcare establishment under the Ministry of Internal Affairs 
    • pass the professional and psychological selection 
    • meet the physical training requirements set by the Ministry of Internal Affairs 
  • female applicants (foreigners and stateless persons) can be admitted to duty if there are vacant positions 
  • the Ministry of Internal Affairs has to approve: 
    • the list of positions which cannot be filled by foreigners and stateless persons 
    • the list of National Guard military units where foreigners and stateless persons will not be allowed to serve to preclude their access to state secrets. 

What is right: 

  • foreigners and stateless persons will be able to serve under contract in the National Guard 
  • the procedure for admitting foreigners to service in the National Guard has been legally established, as well as their rights and duties. 

Background information: on June 10, 2016, a presidential decree regulating the service of foreigners and stateless persons in the Armed Forces of Ukraine came into effect. On February 27, 2024, President Volodymyr Zelensky announced the creation of the International Legion of Territorial Defense of Ukraine.
