New rules for reservation

Who is affected: state bodies, local self-government bodies, enterprises, institutions and organizations that are critical for meeting the needs of the Defense Forces of Ukraine, the economy and the livelihoods of the population during a special period 

Summary:  

• determines that the reservation of persons liable for military service is carried out in accordance with the decision of the Ministry of Economy on the lists of persons liable for military service approved by the Ministry of Defense (or the Security Service of Ukraine, the Foreign Intelligence Service, the Defense Intelligence of Ukraine), in paper and/or electronic form or in electronic form through Diia; 
• approves the rules for reservation through Diia:
  • The Ministry of Economy, through Diia, enters into the Unified List the state bodies that may reserve employees. The relevant state body adds enterprises and institutions to the Unified List;  
  • the head of the institution or enterprise submits lists of persons liable for military service who need to be reserved via Diia;  
  • after online verification of data (military registration and official employment) and a positive decision of the Ministry of Economy, the person liable for military service is considered to be reserved; 
  • at the request of an employee in electronic form, submitted through Diia, an extract on the reservation of a person liable for military service may be generated – this is a document confirming the postponement of the person liable for military service; 
  • Persons liable for military service who are reserved are granted a deferment from call-up during mobilization; 
  • the reservation period can be either 12 months or the entire period of mobilization, or the duration of a contract for the supply of goods, performance of works or provision of services for defense purposes;  
  • it is possible to reserve persons liable for military service regardless of military rank, age and military specialty; 
  • it is possible to reserve up to 100% of employees for companies that have contracts with the Armed Forces and meet the needs of the security and defense forces;  
  • By July 6, 2024, the Ministry of Digital Transformation must ensure the technical ability to submit a notice of inclusion in the lists of public authorities, local governments, enterprises, institutions, organizations that are critical to the defense forces, the economy and the livelihoods of the population for the reservation of persons liable for military service in electronic form through Diia;  
• deferrals from mobilization granted to persons liable for military service by decisions of the Ministry of Economy before the entry into force of this resolution are valid for the period for which they were granted. 

What is right:  

• digitalization of the reservation process;  
• eliminating the shortcomings of the current reservation procedure. 

Background information: On April 11, 2024, the Verkhovna Rada of Ukraine passed a bill on mobilization, which defined the categories of persons liable for military service who could be reserved.
