Draft bill #11096 of March 20, 2024

Status: sent for review to the Committee of the Verkhovna Rada of Ukraine on National Security, Defense, and Intelligence 

Who is affected: persons subject to military service, National Police, National Anti-Corruption Bureau, State Bureau of Investigations, prosecution bodies, Bureau of Economic Security, State Emergency Service, State Criminal-Executive Service, Court Security Service, State Special Transportation Service, State Tax Service, and State Customs Service 

Summary: 

  • several categories of officials will be eligible for deferment: 
    • state officials of category A, heads of oblast, raion, and city district councils (if the city has district councils), as well as village, settlement, and city heads 
    • state officials of categories B and C — up to 50% of the number of employees subject to military service in the corresponding state or local government body 
    • employees of the National Police, NABU, SBI, prosecution bodies, Bureau of Economic Security, State Emergency Service, State Criminal-Executive Service, Court Security Service, State Special Transportation Service, court personnel, other state bodies and institutions of the justice system and bodies of pre-trial investigation, and patronage services 
    • employees and ultimate beneficial owners of enterprises, institutions, and organizations that are critically important for the economy, the livelihood of the population, and the needs of the Armed Forces and other military units during the special period 
  • persons entitled to deferment will have to update their registration data via the electronic cabinet of a conscript, person subject to military service, or reservist, or at the recruitment centers at their location 
  • persons enlisted for service in the National Police, SBI, prosecution bodies, Bureau of Economic Security, State Emergency Service, State Criminal-Executive Service, Court Security Service, State Special Transportation Service, State Tax Service, and State Customs Service who have special ranks will have to register as persons subject to military service and not as conscripts or reservists 
  • persons from the categories listed above will have to register as persons subject to military service at recruitment centers within 60 days after the law comes into effect. 

What is right: the bill addresses the issue of deferment and registration for employees of a number of state bodies with special ranks. 

What is wrong:  

  • issues of deferment and military registration are under review by the dedicated parliamentary committee preparing the bill on mobilization for the second reading. New proposals should not be submitted in a separate draft bill 
  • employees of the State Tax Service and State Customs Service are included in the list of persons subject to military service but are not included in the list of persons entitled to deferment.
