Who is affected: judges of the High Anti-Corruption Court
Summary:
the procedure for reviewing criminal proceedings by the High Anti-Corruption Court (HACC) will be changed:
- for cases where the HACC is the court of original jurisdiction, a criminal proceeding will be considered by one judge, not a panel of three judges
- for cases where the HACC is the appeal court, the mandatory requirement for at least one of the three judges to have a tenure of no less than 5 years will be removed.
What is right:
- the HACC will be able to consider cases within a reasonable time
- the efficiency of the HACC will increase since it will be able to consider cases faster
- the bill implements the state program on anti-corruption 2023—2025
- the bill contributes to the implementation of recommendations by the European Commission for Ukraine’s EU membership as part of strengthening the anti-corruption infrastructure.
