Who is affected: individuals and legal entities, state bodies, local self-government bodies, the National Agency for Corruption Prevention (NACP), and the Cabinet of Ministers of Ukraine 

Summary: 

  • approves the provisions on the Transparency Register (hereinafter — the Register) 
  • maintenance of the Register will be ensured by the NACP 
  • the NACP will manage the Register in Ukrainian and English using software developed according to national standards 
  • the Register will include information about: 
  • the lobbying entity 
  • the client or other beneficiary (if the lobbying is conducted in the commercial interests of the beneficiary under a lobbying agreement) 
  • the subject of lobbying 
  • the amount of funds received and spent by the lobbying entity ranging from up to 100,000 UAH to over 10 million UAH 
  • reporting of the lobbying entities 
  • the NACP will provide open 24/7 access to the public part of the Register, allowing for searching, viewing, copying, and printing of information, as well as obtaining (downloading) documents in a visually accessible format, including HTML 
  • users of the Register include: 
    • public registrars — authorized employees of the NACP with access to information (including information with limited access) 
    • producers of registry information — lobbying entities performing the functions of registrars 
    • the Register administrator responsible for its functioning 
    • individuals and legal entities with Internet access to the public part of the Register to search, view, copy, and print information about lobbying entities and their reporting (except for information with limited access). 

What is right: the provisions on the Transparency Register serve as the core document defining the operations, maintenance procedures, and access to the Transparency Register, as well as information contained in it. 

Why this is important: the launch of the Transparency Register is a mandatory prerequisite for the Law on Lobbying. It should be operational no later than January 1, 2025. However, a draft bill has been registered proposing to postpone the implementation of the law until September 1, 2025. 

Background information: on November 8, 2023, Ukraine received recommendations from the European Commission regarding EU membership, which included the adoption of a law regulating lobbying in accordance with European standards as part of an anti-oligarchic action plan. On March 12, 2024, the President of Ukraine signed the Law on Lobbying.
