Who is affected: employees of the territorial centers for recruitment and social support and members of military medical commissions (MMCs) 

Summary: 

  • criminal liability will be introduced for the head and members of the MMC if they knowingly violate the rules of medical examination of conscripts. This will apply to both illegal conscription into the army and unjustified release from service. Penalties will include: 
    • from 2 to 5 years of imprisonment 
    • if the crime was committed by a group of individuals upon their prior conspiracy — 3 to 6 years of imprisonment with a ban on holding certain positions or engaging in certain activities for 1 to 3 years 
    • under martial law — 3 to 8 years of imprisonment with a ban on holding certain positions or engaging in certain activities for 1 to 3 years 
  • criminal liability will be introduced for the officials of the territorial centers for recruitment and social support for violations of conscription rules that lead to illegal conscription or evasion from service. Penalties will include: 
    • disciplinary limitation for up to 2 years, detention in a disciplinary battalion for the same term, or for up to 5 years imprisonment 
    • during a state of emergency — imprisonment 3 to 6 years of imprisonment with a ban on holding certain positions or engaging in certain activities for 1 to 3 years 
    • under martial law — 3 to 8 years of imprisonment with a ban on holding certain positions or engaging in certain activities for 1 to 3 years. 

What is right: the cosponsors of the bill focus on preventing fraud and corruption during conscription. This should make the accounting and mobilization process more honest and transparent. 

Why this is important: when the system works honestly and transparently, and the rights of individuals are upheld, citizens trust the state more, which is very important in times of war and general mobilization.
