Who is affected: the judiciary system and the Armed Forces of Ukraine 

Summary: 

  • the bill contains amendments to criminal procedural and administrative procedural legislation regarding the jurisdiction (which court has the right to consider cases of particular types) of military garrison courts: 
    • military garrison courts will consider exclusively military crimes committed by service members, military officials, conscripts, and reservists (during drills) 
    • military garrison courts will monitor the observance of rights and freedoms in these cases 
    • only military garrison courts will have the authority to consider such cases 
    • from the day military garrison courts commence operations, investigative judges of general jurisdiction courts will stop accepting motions and complaints in criminal proceedings, while trial courts will stop accepting indictment acts in criminal proceedings. These motions and indictment acts will be submitted to military garrison courts 
    • motions and complaints received by investigative judges that were not resolved before the commencement of the corresponding military garrison court will be promptly transferred to the military garrison court for consideration in accordance with established procedures by the investigative judges of that court. 

What is right: if the draft bill on military courts is adopted, it is necessary to align the affected procedural legislation with the provisions of the draft bill. These amendments provide the legal definition of the jurisdiction of military garrison courts.
