Who is affected: judges and the State Judicial Administration
Summary:
- in 2025, all judges of local courts will receive additional monthly payments:
- a special bonus of 10,510 UAH
- a special bonus of 10,510 UAH if the court operates in a region where the average case consideration time exceeds the national average (this list will be approved by the Council of Judges of Ukraine each quarter)
- a special bonus of 21,020 UAH if a judge works in an active combat zone or in territories temporarily occupied by Russia without a date for the end of hostilities
- a special bonus of 10,510 UAH if the judge works in a potential combat zone without a date for the end of hostilities
- special bonuses will be temporary
- bonuses will not be considered part of judges’ remuneration: they will not be used to recalculate previously assigned monthly lifetime monetary maintenance or affect it.
What is right:
- the bill ensures the provision of a special bonus for judges of local courts, which is prescribed by article 41 of the Law of Ukraine on the Government Budget of Ukraine for 2025, as well as other special bonuses related to excessive workloads and the administration of justice in courts located in areas of active combat, potential combat zones, or in temporarily occupied territories.
What is wrong:
- the introduction of a special bonus for excessive workload may lead to the artificial prolongation of case consideration by judges to receive this allowance.
Alternative solution:
- exclude the introduction of a special bonus for excessive workload.
