Extracts from the presidential decree of July 18, 2022, by which Volodymyr Zelensky terminated the Ukrainian citizenship of, among others, <span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/itd.rada.gov.ua\/billInfo\/Bills\/pubFile\/1524830\">Vadym Rabinovych<\/a><\/span> and <a style=\"color: #000000;\" href=\"https:\/\/itd.rada.gov.ua\/billInfo\/Bills\/pubFile\/1524846\">I<span style=\"color: #800000;\">hor Vasylkovskyi<\/span><\/a><span style=\"color: #800000;\">,<\/span> are included as annexes to the draft resolutions.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><b>What is right: <\/b>the resolutions are in line with the Constitution since the Constitution provisions<span style=\"color: #800000;\"> <a style=\"color: #800000;\" href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/254%D0%BA\/96-%D0%B2%D1%80#n4435\">an early removal<\/a><\/span> of MPs whose citizenship of Ukraine is terminated.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><b>What is wrong: <\/b>it took MPs a long time to submit these draft resolutions and the final decision is not made still. The President issued his decree over 3 months ago, on July 18, and the Parliament has not yet properly responded to the termination of MPs\u2019 citizenship.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\">The MPs in question <span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/t.me\/yzheleznyak\/2632\">were expelled<\/a><\/span> from parliamentary committees only on October 6: Ihor Vasylkovskyi \u2014 from the Committee on Transport, Vadym Rabinovych \u2014 from the Committee on Human Rights. Also, <span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/t.me\/yzheleznyak\/2767\">according<\/a><\/span> to Yaroslav Zhelezniak, Ihor Vasylkovskyi was present at the parliamentary session on July 27 and participated in voting on the Prosecutor General.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><b>What\u2019s next: <\/b>Ihor Vasylkovskyi was elected in a single-mandate district, so an intermediate election will be held to replace him. Vadym Rabinovych represents a political party that was banned so it is doubtful that any of his colleagues will take his place. The most probable scenario is that new MPs will join the parliament after martial law ends.\u00a0<\/span><\/p>\n<h2><span style=\"color: #800000;\"><b>Status of an MP \u2014 the restorer of independence of Ukraine<\/b>\u00a0<\/span><\/h2>\n<p><span style=\"color: #800000;\"><b>Draft bill <\/b><a style=\"color: #800000;\" href=\"https:\/\/itd.rada.gov.ua\/billInfo\/Bills\/Card\/40725\"><b>#\u202f8157 of October 27, 2022<\/b><\/a>\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><b>Sponsor: <\/b>Serhii Taruta, member of the Batkivshchyna faction.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><b>Who is affected: <\/b>MPs of the first convocation, the Verkhovna Rada, members of the NGO Association of the People\u2019s Deputies of Ukraine, government bodies, local governments, private and state-owned enterprises, establishments, and organizations.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><b>Summary of the bill:<\/b>\u00a0<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">introduces a status of an MP \u2014 the restorer of independence, a parliamentarian of the first convocation who supported the Declaration of State Sovereignty of Ukraine, the Act of Declaration of Independence of Ukraine, or the resolution On Proclaiming the Independence of Ukraine\u00a0<\/span><\/li>\n<li><span style=\"color: #000000;\">proposals to grant this status or deprive of this status will be submitted to the Head of the Parliament by the NGO Association of the People\u2019s Deputies of Ukraine. Final decisions on the matter will be made by the majority vote in the Verkhovna Rada\u00a0<\/span><\/li>\n<li><span style=\"color: #000000;\">a restorer of the independence will be granted the following rights:\n<p><\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">to attend open sessions of the Parliament and its bodies\u00a0<\/span><\/li>\n<li><span style=\"color: #000000;\">to freely attend government bodies, local governments, enterprises, establishments, and organizations\u00a0<\/span><\/li>\n<li><span style=\"color: #000000;\">to get a diplomatic passport\u00a0<\/span><\/li>\n<li><span style=\"color: #000000;\">to submit appeals that will have legal power equal to MPs\u2019 appeals.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"color: #000000;\">the restorers will be eligible for a lifelong monthly allowance of one minimum wage.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><b>What is right: <\/b>commemoration and recognition of the achievements of MPs of the first convocation who fought for and supported the independence of Ukraine.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><b>What is wrong: <\/b>the list of rights that the bill proposes to grant to MPs \u2014 the restorers of independence, is excessive. In particular, it is unclear why they need diplomatic passports, the right to freely attend government bodies and enterprises, and submit appeals equal to MPs\u2019 appeals.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><b>Alternative solution: <\/b>MPs of the first convocation who supported the independence of Ukraine deserve commemoration, recognition, and support. However, they should not get excessive rights they can exploit.
