The Commissioner can be legitimately dismissed only in cases <\/span><span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/776\/97-%D0%B2%D1%80#Text\"><span lang=\"en-US\">defined in the law<\/span><\/a><\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"color: #000000;\"><span lang=\"en-US\">the resolution violates the law <\/span><span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/389-19#Text\"><span lang=\"en-US\">On the Legal Regime of Martial Law<\/span><\/a><\/span><span lang=\"en-US\"> that prohibits dismissing the Commissioner for Human Rights while martial law is in effect<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">the dismissal of Denisova will be challenged in court. The former Commissioner will probably be restored to her position.<\/span><\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: left;\" align=\"justify\"><span style=\"color: #000000;\"><span lang=\"en-US\"><strong>What else<\/strong>: <\/span><span lang=\"en-US\">in 2017, the Verkhovna Rada introduced an open ballot system for voting for the candidates for the Commissioner for Human Rights and dismissal of the Commissioner. That decision made the institution political and thus violated the requirement that the Commissioner has to be independent of other state bodies and officials.<\/span><\/span><\/p>\n<h2 style=\"text-align: left;\" align=\"center\"><span style=\"color: #800000;\"><strong><span lang=\"en-US\">Allocation of extra funding for state defense needs<\/span><\/strong><\/span><\/h2>\n<p style=\"text-align: left;\" align=\"center\"><span style=\"color: #800000;\"><strong><span lang=\"en-US\">Draft bill <\/span><a style=\"color: #800000;\" href=\"https:\/\/itd.rada.gov.ua\/billinfo\/Bills\/CardByRn?regNum=7413&amp;conv=9\"><span lang=\"en-US\">#\u00a07413<\/span><\/a><span lang=\"en-US\"> of May 26, 2022<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\"><span lang=\"en-US\"><strong>Status<\/strong>: <\/span><span lang=\"en-US\">adopted as a law.<\/span><\/span><\/p>\n<p style=\"text-align: left;\" align=\"justify\"><span style=\"color: #000000;\"><span lang=\"en-US\"><strong>Who is affected<\/strong>: <\/span><span lang=\"en-US\">the Verkhovna Rada, the Cabinet, the Ministry of Defense, the Ministry of Internal Affairs, the SSU, the Chief Directorate of Intelligence, the <\/span><span lang=\"en-US\">Foreign Intelligence Service, IDPs, pensioners, and political parties.<\/span><\/span><\/p>\n<p style=\"text-align: left;\"><strong><span lang=\"en-US\" style=\"color: #000000;\">Summary of the bill:<\/span><\/strong><\/p>\n<ul style=\"text-align: left;\">\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">expenditures from the government budget in 2022 will be increased by \u20b4287\u00a0bln (the surplus expected to be received from external loans)<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">state funding of political parties will be terminated starting from the second quarter of 2022<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">the Cabinet gets the authority to reallocate budget funds at its discretion without consulting the Budget Committee of the Verkhovna Rada<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">expenditures on the needs of the Ministry of Defense will be increased by \u20b4166\u00a0bln (\u20b478\u00a0bln will be spent on salaries in the defense sector)<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">expenditures on the needs of the Ministry of Foreign Affairs (including the National Guard, the National Police, the State Border Service, the State Emergency Service, and the State Migration Service) by \u20b476\u00a0bln (\u20b456\u00a0bln will be spent on salaries for these agencies)<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">expenditures on the needs of the chief Directorate of Intelligence will be increased by \u20b41\u00a0bln, the SSU \u2014 by \u20b42.7\u00a0bln<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">additional funding of almost \u20b46\u00a0bln will be allocated for the eHelp program<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span style=\"color: #000000;\">\u20b4<span lang=\"en-US\">12.5\u00a0bln will be allocated to aid the IDPs and additional \u20b420\u00a0bln \u2014 for the Pension Fund.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"color: #000000;\"><span lang=\"en-US\"><strong>What is right<\/strong>: <\/span><span lang=\"en-US\">an increase in government expenditures is a necessity. Ukraine has to spend more on the needs of defense and security, provide aid for IDPs, and ensure continuity of pension payments.<\/span><\/span><\/p>\n<p align=\"justify\"><strong><span lang=\"en-US\" style=\"color: #000000;\">What is wrong:<\/span><\/strong><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span lang=\"en-US\">the removal of parliamentary control over the reallocation of government funds creates unjustified risks of abuse by the executive branch in a time when the freedom of speech and other civic control mechanisms over the activities of the executive branch are significantly restricted due to the war and martial law<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\">termination of state funding of political parties will increase their dependency on oligarchic capital and looks like an attempt by the parties in power to oppress their competitors. The draft bill does not propose to cut or suspend any other state-funded program.<\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"justify\"><span lang=\"en-US\"><strong>Alternative solution<\/strong>: <\/span><span lang=\"en-US\">to strengthen controlling mechanisms over budget expenditures. Otherwise, the level of corruption in the executive branch and the percentage of state funding misuse will significantly increase.<\/span><\/p>\n<h2 align=\"justify\"><span style=\"color: #800000;\"><strong><span lang=\"en-US\">Sanctions against the leadership of the russian orthodox church<\/span><\/strong><\/span><\/h2>\n<p align=\"justify\"><span style=\"color: #800000;\"><strong><span lang=\"en-US\">Draft Resolution of the Verkhovna Rada <\/span><a style=\"color: #800000;\" href=\"https:\/\/itd.rada.gov.ua\/billInfo\/Bills\/Card\/39516\"><span lang=\"en-US\">#\u00a07332<\/span><\/a><span lang=\"en-US\"> of April 29, 2022<\/span><\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><span lang=\"en-US\"><strong>Who is affected<\/strong>: <\/span><span lang=\"en-US\">the leadership of the russian orthodox church<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000;\"><span lang=\"en-US\"><strong>Summary of the resolution<\/strong>: <\/span><span lang=\"en-US\">proposes the National Security and Defense Council to impose sanctions \u2014 to block assets, impose a ban on business operations, and annul official visits \u2014 against the following persons:<\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">patriarch Kirill (Vladimir Gundyayev)<\/span><\/p>\n<\/li>\n<li>\n<p align=\"justify\"><span lang=\"en-US\" style=\"color: #000000;\">chairman of the department of external church relations Hilarion (Grigoriy Alfeyev) and his deputy archpriest Nikolay Balashov<\/span><\/p>\n<\/li>\n<li><span lang=\"en-US\" style=\"color: #000000;\">metropolitan of Pskov Tikhon (Georgiy Shevkunov)<\/span><\/li>\n<\/ul>\n<p align=\"justify\"><span style=\"color: #000000;\"><span lang=\"en-US\"><strong>What is right<\/strong>: <\/span><span lang=\"en-US\">it is justified to impose these sanctions since the leadership of the russian orthodox church on multiple occasions voiced its support for the aggressive russian war against Ukraine and used its position as clergymen to promote and justify this aggressive war.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"color: #000000;\"><span lang=\"en-US\"><strong>What\u2019s next<\/strong>: <\/span><span lang=\"en-US\">a final decision to impose sanctions has to be made by the National Security and Defense Council, and the President has to enact it with his decree.<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>MPs dismissed the Commissioner for Human Rights, allocated more funding for defense needs, and proposed to impose sanctions against patriarch Kirill of the russian orthodox church.
