Now, some MPs are trying to restore the \u201clegitimacy\u201d of the SBI why others are proposing to simplify the procedure for dismissing the SBI Director.<\/span><\/p>\n<h2><strong><span style=\"color: #800000;\">Amendments to the Law on SBI making it compliant with the Constitution<\/span><\/strong><\/h2>\n<p><strong><span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/itd.rada.gov.ua\/billInfo\/Bills\/Card\/38947\">Draft bill #7022 of February 4, 2022<\/a><\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><strong>Cosponsors:<\/strong> 9 MPs from Holos faction \u2014 members of Justice group, with <span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/centreua.us15.list-manage.com\/track\/click?u=0e9d6ee6b71a633cc0e1c6fc8&amp;id=82e3aeb9ff&amp;e=f588c8fd9b\">Oleksandra Ustinova<\/a> <\/span>as the first signatory.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Who is affected<\/strong>: the President, MPs, the Cabinet, employees of the SBI, top officials, service members, and civil servants.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Summary of the bill<\/strong>: the bill proposes amendments to the Law on the SBI similar to <a style=\"color: #000000;\" href=\"https:\/\/centreua.us15.list-manage.com\/track\/click?u=0e9d6ee6b71a633cc0e1c6fc8&amp;id=eb4d5cf8ff&amp;e=f588c8fd9b\"><span style=\"color: #800000;\">those adopted for the Law on NABU<\/span><\/a>:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">the SBI will be transformed from a law enforcement agency into a central executive body<\/span><\/li>\n<li><span style=\"color: #000000;\">the authority to influence the appointment of the SBI Director will be taken away from the President and Parliament, instead this authority will be granted to the Cabinet<\/span><\/li>\n<li><span style=\"color: #000000;\">committee for the selection of the SBI Head will be formed by the Cabinet: it will propose three members itself and the other three will be nominated by international and foreign organizations<\/span><\/li>\n<li><span style=\"color: #000000;\">at the same time, the SBI will be independent from the Cabinet in its work:<\/span>\n<ul>\n<li><span style=\"color: #000000;\">it will decide on the structure of its apparatus<\/span><\/li>\n<li><span style=\"color: #000000;\">approve its statute<\/span><\/li>\n<li><span style=\"color: #000000;\">decide on state registration of acts<\/span><\/li>\n<li><span style=\"color: #000000;\">the Cabinet will not have the authority to give any orders to the SBI.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><strong>Why this is important<\/strong>:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">in 2019-2020, the Constitutional Court adopted several decisions recognizing state regulators, the NABU and SBI as central executive bodies that have to be subordinate to the Cabinet, not the President or the Parliament (decisions on <span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/v005p710-19#Text\">the National Commission for State Regulation of Energy and Public Utilities<\/a>,<\/span> <span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/v007v710-19#Text\">constitutional amendments<\/a><\/span>, <a style=\"color: #000000;\" href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/v009p710-20#n69\"><span style=\"color: #800000;\">appointment of the NABU Director<\/span><\/a>, and <span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/v011p710-20#n2\">President\u2019s influence over the NABU<\/a>)<\/span>. Thus, current Law on SBI violates the Constitution<\/span><\/li>\n<li><span style=\"color: #000000;\">in December of 2019, the Verkhovna Rada \u201cre-launched\u201d the SBI by transforming it into a state law enforcement agency and making it subordinate to the President.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><strong>What is right<\/strong>: amendments proposed by the bill will make the Law on SBI compliant with the Constitution. This will prevent the Constitutional Court from repealing provisions of the law as unconstitutional and ruling \u201cillegal\u201d SBI\u2019s work.<\/span><\/p>\n<h2><strong><span style=\"color: #800000;\">Updated procedure for dismissing SBI Director<\/span><\/strong><\/h2>\n<p><strong><span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/centreua.us15.list-manage.com\/track\/click?u=0e9d6ee6b71a633cc0e1c6fc8&amp;id=76a3c38a2d&amp;e=f588c8fd9b\">Draft bill #7022 of February 4, 2022<\/a><\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><strong>Cosponsors<\/strong>: 14 MPs from the European Solidarity faction, with <a style=\"color: #000000;\" href=\"https:\/\/centreua.us15.list-manage.com\/track\/click?u=0e9d6ee6b71a633cc0e1c6fc8&amp;id=71dd68ac1f&amp;e=f588c8fd9b\"><span style=\"color: #800000;\">Iryna Herashchenko<\/span><\/a> as the first signatory.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Who is affected:<\/strong> the President, MPs, the Cabinet, employees of the SBI, top officials, service members, and civil servants.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Summary of the bill:<\/span><\/strong><\/p>\n<ul>\n<li><span style=\"color: #000000;\">provisions that the Verkhovna Rada can at any time initiate a vote of no confidence to dismiss the SBI Director and needs 150 MPs to pass such a vote<\/span><\/li>\n<li><span style=\"color: #000000;\">the President will be obliged to dismiss the SBI Director if the Parliament votes no confidence.<\/span><\/li>\n<\/ul>\n<p><strong><span style=\"color: #000000;\">What is wrong:<\/span><\/strong><\/p>\n<ul>\n<li><span style=\"color: #000000;\">the bill violates the Constitution by extending the authority of the Verkhovna Rada. Only the Verkhovna Rada can schedule regular and early elections to local councils<\/span><\/li>\n<li><span style=\"color: #000000;\">the Parliament protects the right of community members for local self-governance.
