In addition, one of his decrees will probably result in yet another failure to select a representative from Ukraine to be appointed as a judge of the European Court of Human Rights.<\/p>\n<h2><span style=\"color: #800000;\"><strong>New Head of Kherson Oblast State Administration appointed<\/strong><\/span><\/h2>\n<p><span style=\"color: #800000;\"><strong>Presidential decrees <\/strong><a style=\"color: #800000;\" href=\"https:\/\/www.president.gov.ua\/documents\/5532021-40477\"><strong>#553\/2021<\/strong><\/a><strong> and <\/strong><a style=\"color: #800000;\" href=\"https:\/\/www.president.gov.ua\/documents\/5522021-40473\"><strong>#552\/2021<\/strong><\/a><strong> of October 26, 2021<\/strong><\/span><\/p>\n<p><strong>Who is affected:<\/strong> inhabitants of Kherson oblast, Ukrainian citizens, government bodies, local governments, the Verkhovna Rada, the Cabinet, and the President.<\/p>\n<p><strong>Summary of the decrees:<\/strong> Serhii Kozyr is dismissed as the Head of Kherson Oblast State Administration and Hennadii Lahuta is appointed in his stead.<\/p>\n<p><strong>What is wrong:<\/strong><\/p>\n<ul>\n<li><a href=\"https:\/\/www.cvk.gov.ua\/pls\/vnd2019\/wp407pt001f01=923pf7201=22066.html\">Serhii Kozyr<\/a> from Servant of the People party and <a href=\"https:\/\/www.cvk.gov.ua\/pls\/vnd2019\/wp407pt001f01=923pf7201=22041.html\">Hennadii Lahuta<\/a> from Party of Ihor Kolykhaiev We Are to Live Here! are both candidates running for the vacant parliamentary seat in <a href=\"https:\/\/www.cvk.gov.ua\/pls\/vnd2019\/wp024pt001f01=923pid100=65pf7331=184.html\">a single-mandate district #184<\/a> with a center in Kahovka, Kherson oblast<\/li>\n<li>right after his appointment as the head of state administration, Hennadii Lahuta announced that he <a href=\"https:\/\/www.ukrinform.ua\/rubric-regions\/3340302-peregoni-na-hersonsini-laguta-znavsa-z-viboriv-na-korist-kandidata-vid-slugi-narodu.html\">withdraws his candidature<\/a><\/li>\n<li>politicians in power made an agreement with the candidate: he received a position of the head of oblast state administration in exchange for his withdrawal from running for the parliament. While civil service positions are traded in such a fashion, the quality of the service\u2019s work and implementation of government policies in regions will hardly improve.<\/li>\n<\/ul>\n<p><strong>Background:<\/strong><\/p>\n<ul>\n<li>Ihor Kolykhaiev, an MP elected in district #184, <a href=\"https:\/\/www.ukrinform.ua\/rubric-elections\/3137220-u-hersoni-vibori-mera-vigrav-kolihaev.html\">was elected the mayor of Kherson<\/a> and stepped down as an MP<\/li>\n<li><a href=\"https:\/\/www.oporaua.org\/news\/vybory\/23596-pislia-priznachennia-golovoiu-khersonskoyi-oda-gennadii-laguta-zalishitsia-u-viborchomu-biuleteni-iak-kandidat-po-okrugu-184\">according to Civil Network OPORA<\/a>, Hennadii Lahuta is still registered as a candidate: his registration cannot be canceled since he should have submitted his withdrawal to the Central Election Commission before October 18<\/li>\n<li>the election in district #184 will be held on October 31.<\/li>\n<\/ul>\n<h2><span style=\"color: #800000;\"><strong>New competition for the position of a judge of the European Court of Human Rights from Ukraine started<\/strong><\/span><\/h2>\n<p><span style=\"color: #800000;\"><strong>Presidential decree <\/strong><a style=\"color: #800000;\" href=\"https:\/\/www.president.gov.ua\/documents\/5502021-40469\"><strong>#550\/2021<\/strong><\/a><strong> of October 26, 2021<\/strong><\/span><\/p>\n<p><strong>Who is affected: <\/strong>citizens of member countries of the Council of Europe, businesses, domestic and foreign government bodies and local governments.<\/p>\n<p><strong>Summary of the decree:<\/strong><\/p>\n<ul>\n<li>appoints a new selection committee<\/li>\n<li>updates the competition procedure:\n<ul>\n<li>allows online participation in committee\u2019s meetings<\/li>\n<li>shifts the responsibility of defining the format of interviews and the procedure of evaluating the candidates on the selection committee.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Why this is important:<\/strong><\/p>\n<ul>\n<li>this is the third competition for the position. Twice before the Parliamentary Assembly of the Council of Europe (PACE) rejected candidates proposed by Ukraine and <a href=\"https:\/\/www.echr.com.ua\/parye-zabrakuvala-kandidativ-u-suddi-yespl-vid-ukra%D1%97ni\/\">urged to conduct another competition<\/a><\/li>\n<li><a href=\"https:\/\/www.eurointegration.com.ua\/experts\/2021\/10\/6\/7128657\/\">Yevhen Zakharov, the Director of Kharkiv Human Rights Protection Group<\/a>, explains the rejections as follows:\n<ul>\n<li>Ukrainian authorities are trying to get a loyal judge in the ECHR<\/li>\n<li>competitions were not compliant with the requirements of the Council of Europe<\/li>\n<li>there were no consultations with the Advisory Panel of Experts of the Council of Europe<\/li>\n<\/ul>\n<\/li>\n<li>Ukraine is represented in the European Court on Human Rights by judge Ganna Yudkivska whose mandate expired back in June of 2019.<\/li>\n<\/ul>\n<p><strong>What is right: <\/strong>the committee includes representatives from universities, an attorney, and a judge.<\/p>\n<p><strong>What is wrong: <\/strong>the competition procedure can still fail to comply with the requirements of the European Council. In particular, it lacks well-defined criteria for evaluating candidates and determining the winners.
