{"id":16619,"date":"2026-08-26T14:42:55","date_gmt":"2026-08-26T12:42:55","guid":{"rendered":"https:\/\/centreua.org\/?p=16619"},"modified":"2026-08-26T14:42:55","modified_gmt":"2026-08-26T12:42:55","slug":"state-support-for-critical-infrastructure-enterprises-during-the-winter-period","status":"publish","type":"post","link":"https:\/\/centreua.org\/en\/monitoring\/state-support-for-critical-infrastructure-enterprises-during-the-winter-period\/","title":{"rendered":"State support for critical infrastructure enterprises during the winter period"},"content":{"rendered":"<p><a href=\"https:\/\/itd.rada.gov.ua\/billinfo\/Bills\/Card\/70462\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Draft Law No. 15490 of 07.08.2026<\/strong><\/a><\/p>\n<p><strong>Initiators:<\/strong> 7 members of parliament from the &#8220;Servant of the People&#8221; faction, led by Maksym Zaremskyi.<\/p>\n<p><strong>Who is affected:<\/strong> critical infrastructure enterprises: hospitals, water utilities, municipal heating and power utilities, schools, kindergartens, and others.<\/p>\n<p><strong>Summary:<\/strong><\/p>\n<p>The draft law declaratively enshrines state guarantees regarding:<\/p>\n<ul>\n<li>the continuation of measures of state support for critical infrastructure enterprises during the winter period;<\/li>\n<li>the prevention of any deterioration in the conditions of such support;<\/li>\n<li>the introduction of tax incentives and compensation for the costs of backup power supply for hospitals, water utilities, municipal heating and power utilities, schools, kindergartens, and other critically important facilities.<\/li>\n<\/ul>\n<p>The Cabinet of Ministers is obliged, within three months, to draft the legislation needed to implement this law, to prepare a financial and economic justification of the sources for its implementation, and to submit amendments to the Law on the State Budget for 2026.<\/p>\n<p><strong>What is right:<\/strong><\/p>\n<ul>\n<li>The problem the draft law seeks to address is entirely real. Because of systematic strikes on energy infrastructure, ensuring backup power supply is critically important: in hospitals without generators, doctors cannot perform operations; water utilities without backup power will leave residents without water; and boiler houses without backup power may leave residents without heating in freezing temperatures. At the same time, providing backup power requires additional spending on equipment, fuel, and maintenance, which the draft law proposes to partially compensate through state support.<\/li>\n<li>Setting the three-month deadline for the Cabinet of Ministers provided for by the draft law is the only element with a practical dimension: it creates a formal basis for demanding concrete decisions from the government before the start of the heating season.<\/li>\n<\/ul>\n<p><strong>What is wrong:<\/strong><\/p>\n<ul>\n<li>The draft law contains no provision of direct effect.<\/li>\n<li>The wording of Article 3 of the Law is far too general: &#8220;the state guarantees the taking of measures to provide for tax incentives&#8221; is a triple evasion of any obligation, since what is guaranteed is not an incentive, nor even a measure, but merely the taking of measures so that such an incentive might one day be provided for. Legally, no specific obligation follows from such a provision: no enterprise will be able to invoke it, no court will be able to apply it, and no authority will breach it by failing to comply.<\/li>\n<li>The draft law does not define a single key concept. In particular, what constitutes the &#8220;winter period&#8221;: calendar winter, the heating season, or the period of validity of a separate government decision? Which enterprises exactly are covered: the list of critical infrastructure under the relevant sectoral law, or something else? What does the &#8220;continuation&#8221; of measures mean: which measures are already being implemented, and the continuation of what is being guaranteed? These questions have no answer in the text of the draft law.<\/li>\n<li>It is unclear how a &#8220;deterioration in the conditions&#8221; of state support is to be determined. Article 2 on &#8220;preventing the deterioration of conditions&#8221; is a classic non-regression provision \u2014 but without an established baseline. It does not specify what the current conditions are, and therefore it is impossible to determine the moment at which they deteriorate. The provision is inapplicable by construction.<\/li>\n<li>A financial and economic justification of the sources for implementing a law cannot be prepared after its adoption. Article 27 of the Budget Code requires that a draft law affecting budget indicators be accompanied by such a justification at the time of submission.<\/li>\n<\/ul>\n<p><strong>Alternative solution:<\/strong><\/p>\n<p>The problem of backup power supply for critical facilities requires not declarative guarantees, but concrete support mechanisms and corresponding amendments to current legislation:<\/p>\n<ul>\n<li>Tax incentives \u2014 specific amendments to the Tax Code.<\/li>\n<li>A compensation mechanism \u2014 a separate procedure with a defined share of compensation (for example, 70\u2013100% for healthcare facilities and water utilities), a source of funding, criteria for selecting facilities, and payment deadlines. Without these parameters, &#8220;compensation of costs&#8221; remains a declaration.<\/li>\n<li>A register of protected facilities \u2014 the draft law should establish the criteria by which an enterprise falls within the scope of support (sector, criticality category, location relative to the combat zone), the body that compiles the list, and the body that approves it, tied to the existing legislation on critical infrastructure. It is logical for the Cabinet of Ministers itself to approve the list \u2014 but the law must define the rules by which it does so, otherwise the boundaries of support will remain at the government&#8217;s discretion.<\/li>\n<li>A definition of the concept of the &#8220;winter period&#8221; tied to the heating season with clear start and end dates, rather than to a calendar concept.<\/li>\n<li>The financial and economic justification must precede adoption, not follow it. Otherwise parliament votes for an obligation without understanding its cost, and the government receives a provision it will implement on a residual basis.<\/li>\n<\/ul>\n<p><strong>What else:<\/strong><\/p>\n<p>This is a declarative draft law \u2014 a document that records an intention but creates no mechanism. Such acts appear when the political demand for a response outpaces the readiness to work out a solution: the problem is obvious, public attention is high, while specifics require coordination with the Ministry of Finance, calculations, and compromises on sources of funding.<\/p>\n<p>The cost of declarative legislation is not zero. First, it creates the illusion of a solved problem: once adopted, it can be reported that the issue has been settled by law, while the hospital still has no generator. Second, it erodes the very concept of a law as an act of direct effect, and accustoms people to the idea that a provision may mean nothing.
