{"id":15292,"date":"2025-01-14T14:56:33","date_gmt":"2025-01-14T12:56:33","guid":{"rendered":"https:\/\/centreua.org\/?p=15292"},"modified":"2025-01-14T14:56:33","modified_gmt":"2025-01-14T12:56:33","slug":"deployment-of-the-armed-forces-of-ukraine-abroad","status":"publish","type":"post","link":"https:\/\/centreua.org\/en\/monitoring\/deployment-of-the-armed-forces-of-ukraine-abroad\/","title":{"rendered":"Deployment of the Armed Forces of Ukraine abroad"},"content":{"rendered":"<p><b>Draft bill #<\/b><a href=\"https:\/\/itd.rada.gov.ua\/billInfo\/Bills\/Card\/55550\"><b>12378<\/b><\/a><b> of January 7, 2025<\/b><\/p>\n<p><b>Cosponsors: <\/b><span style=\"font-weight: 400;\">9 MPs from the political parties Servant of the People and Holos with Oleksandr Zavitnevych as the first signatory<\/span><\/p>\n<p><b>Status: <\/b><span style=\"font-weight: 400;\">sent for review to the Committee on National Security, Defense, and Intelligence<\/span><\/p>\n<p><b>Who is affected:<\/b><span style=\"font-weight: 400;\"> service members of the Armed Forces of Ukraine and the President of Ukraine<\/span><\/p>\n<p><b>Summary:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the law will allow sending units of the Armed Forces of Ukraine to other countries for:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">protection of national security<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">repelling armed aggression against Ukraine<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">protection of sovereignty<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">exercising the right to self-defense in accordance with Article 51 of the UN Charter<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the decision to deploy units will be made by the President with subsequent approval from the Verkhovna Rada. An exception will be the use of the Armed Forces on the territory of the aggressor state to repel an attack<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">during the state of war (introduced on February 24, 2022), the provisions of this bill will apply to the units of the AFU that before to the adoption of this law were already in other states to ensure national security, protection from aggression, and protection of Ukraine\u2019s sovereignty.<\/span><\/li>\n<\/ul>\n<p><b>What is right:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the bill will create a legal basis for military operations outside of Ukraine<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the bill expands military cooperation with other states and allows participation in joint operations with partners.<\/span><\/li>\n<\/ul>\n<p><b>What is wrong:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">the bill facilitates a legal collision. The <\/span><a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/1518-14#Text\"><span style=\"font-weight: 400;\">Law<\/span><\/a><span style=\"font-weight: 400;\"> on the Procedure for Deploying Units of the Armed Forces of Ukraine to Other States, which will be amended by this bill, is expanded with the clause about repelling the aggression, while the law in question regulates participation in international missions based on treaties (peacekeeping operations, training, etc.). In other words, it will be applied to the situation of repelling armed aggression, which is of a completely different legal nature.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Article 9 of the <\/span><a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/1518-14#Text\"><span style=\"font-weight: 400;\">law<\/span><\/a><span style=\"font-weight: 400;\"> allows sending Ukrainian service members to participate in combat operations in another state only voluntarily, and the duration of stay is limited to one year. The adoption of the draft bill may complicate military operations on the territory of the aggressor, as the military will receive a legal reason to refuse participation in such operations.<\/span><\/p>\n<p><b>Alternative solution:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">to stipulate that armed aggression can also be repelled on the territory of the aggressor state.
