Better protection of rights for foreigners and stateless persons fighting for Ukraine 

Draft bill #8098 of October 4, 2022 

Status: adopted as a law, awaits to be signed by the Chairperson of the Verkhovna Rada and the President 

Who is affected: foreigners, stateless persons, the Armed Forces of Ukraine, the State Special Transportation Service, the National Guard, migration authorities, and military personnel. 

Summary of the bill: 

  • foreigners and stateless persons will be allowed to serve not only in the Armed Forces of Ukraine but also in the State Special Transportation Service and the National Guard. The law also provisions that in case of death, maiming, or partial loss of the ability to work, they or their families will be eligible for a one-time compensation 
  • foreigners and stateless persons serving under contract with the Armed Forces, the State Special Transportation Service, or the National Guard will have legal temporary residence status for the term of their contracts 
  • persons who have served for three years in the Armed Forces, the State Special Transportation Service, or the National Guard, as well as persons who have served in the Armed Forces, the State Special Transportation Service, or the National Guard and were legally recognized as unfit for service due to health condition, illnesses, or injuries received while on duty, will be included in the immigration quota, i.e. the maximum number of foreigners and stateless persons eligible for obtaining permission to immigrate to Ukraine each year 
  • contracts concluded by the Armed Forces, the State Special Transportation Service, and the National Guard with foreigners and stateless persons are recognized as legitimate and continue to be valid. 

What is right: the bill provides better legal protection and social security for foreigners and stateless persons serving in the ranks of the Armed Forces of Ukraine, the State Special Transportation Service, and the National Guard.
